With the site being put up again, I'm going to be changing the TOS. Here is the new TOS in its entirety, you will need to type "I agree" or something similar in the comments to agree to it. You do not need to do this if you have registered after the date this post is up.
The following terms govern use of eko.aquapyronarpgs.evocrit.com ("Site" or "the Site") and should be considered the rules surrounding usage of Eko characters ("Characters") and licenses to create characters with set restrictions ("MYO Slots"). These rules also apply to which kinds of artwork or written materials (collectively "Art") are permitted on and in connection with the Site.
User Accounts
Users may sign up for an account or elect to not sign up for an account. These terms are binding and apply to Characters even if no account is created. Users must have a DeviantArt or Toyhouse account in order to use the Site or its Characters.
If users break these terms, they may face the following (collectively "Administrative Actions"):
- Character removal or voiding
- Temporary blacklisting from the Site
- Permanent blacklisting from the Site
- Removal of Art or other user-created content from the Site
Blacklisting means that no Characters or MYO Slots may be transferred to the user.
The following materials are not allowed in connection with user profiles or any other user-editable areas of the site (such as Character profiles or submissions):
- NSFW Art, images, or content
- Excessively violent or gory images or content (small amounts of blood are allowed)
Additionally, users are forbidden from knowingly engaging in the following:
- Scams, or trading items, Characters, or MYO Slots the user does not own
- Abuse of site bugs or glitches to obtain items, Characters, MYO Slots, or currency
- Sale of Site invite codes
Ownership
Users own any characters listed under their account or alias. The owner on the masterlist is considered the official owner.
Characters which were created by aquapyrofan can be removed for the following reasons:
- TOS violation in any Aquapyron project.
- TOS violation in connection with any Aquapyron project.
- Violations of conditions on continued use after Administrative Action.
- Violations of intellectual property rights related to any Aquapyron project.
Characters can also be removed if the user's account is bannned, but this only applies to characters which were created by aquapyrofan. Other characters must have species identifying features removed (Voiding) if TOS violation or banning occurs.
Character Usage
Uses allowed by these terms:
- Trading, gifting, and/or reselling Characters as allowed on their profile
- Posting Characters to Toyhouse with proper credits (credit aquapyrofan as an onsite creator)
Uses disallowed by these terms:
- Trading, gifting, and/or reselling Characters as disallowed on their profile
- Posting Characters on Toyhouse with improper credits
- Use of Art or Characters which do not belong to the user (gift art is okay if allowed by the owner)
- Illegal uses of Characters
- Creating or otherwise obtaining NSFW Art involving Characters
- Trading Characters for "vouchers" if their profile indicates that they can't be sold
- Creating or using Characters without the appropriate MYO Slots or otherwise approved designs
Changes
Users may change the design of Characters through the use of onsite items, and must get them approved through the onsite Design Update form.
MYOs
In the case of MYO Characters, or similar, where a user is permitted full control over the designing of a new Character with given restrictions (such as traits or use of a specific file):
- Intellectual property rights of all characters created through "MYOs" are held exclusively by their owner.
- Users are permitted to use the Characters they create through these "MYOs" in the Eko ARPG.
- Characters must not violate intellectual property rights of any individual or company and must not be based on existing characters.
- All other terms apply.
Customs/Semi-Customs
In the case of customs and semi-customs, where a design is created with some input from a user:
- Anything heavily based on or using the name of a trademarked or copyrighted property will be stripped or, if possible, genericized.
- Anything breaking the Content Guidelines will be stripped.
- Anything impossible for or contradicting guidelines of the species will be stripped.
- Eko administration reserves the right to take minor creative liberties with requested details in a semi-custom, or custom.
Infringing Characters
Any Character that was created with input from the owner (through a MYO, semi-custom, etc.) that is found to be based in part or whole on a trademarked or copyrighted property will have the character voided or removed, and the user may face other administrative actions. This does not apply if the basis is minor or generic enough.
Removing/VOiding
Should a character be removed, there will be no compensation for any payments from Eko or its administrators.
Alteration of the design which is to be voided to convert them to another species without removing all species identifying features is forbidden, and can result in the banning or other administrative action.
